Debt Collection

Debt collection occurs when an attorney, an attorney’s agent, or a licensed debt collector collects an outstanding amount plus lawful interest, administrative costs, and collection fees on behalf of the credit provider, which is capped by law. Debt collection is a significant aspect of South Africa’s economy. Debtors owe billions of rands, and the present non-payment rate is having an impact on our economy. Interest rates on unsecured and short-term debt may arise in the future due to more debtors defaulting on their obligations. Whatever collection methods a company uses, the owner must be aware of the constraints imposed by state and federal legislation on debt collecting under the Fair Debt Collection and Practices Act, which controls debt collection from “natural persons” or individuals.

When can debt collection be instituted?

The payment due date will be decided according to the conditions of the specific agreement, and if no due date was given, a reasonable time would be applied, depending on the merits of the case. When a debtor breaches the terms of the agreement by failing, neglecting, or refusing to fulfil his duty or responsibility in terms of repaying money to the creditor, the debt becomes due and payable, according to the terms of the agreement and applicable legislation.

Once a debtor is in default and has been in default for more than 20 working days, a creditor is obligated by law to send the debtor written notice of the default before taking legal action. The notice must offer the consumer the option of resolving their arrears within ten days, making repayment arrangements, or referring the credit agreement to a debt counsellor, alternative dispute resolution agent, consumer court, or ombudsman with jurisdiction, with the goal of the parties resolving any disputes under the agreement. After the 10-day warning period, if the debtor fails to reply to or rejects the creditor’s proposals, the creditor may take legal action against the debtor.
